Motions for Reconsideration Denied in Charter Schools Case

The Supreme Court of Georgia this morning denied the motions for reconsideration filed by the State of Georgia and the charter school defendants in Gwinnett County School District v. Cox, Case No. S10A1773. The denials were the same as the original decisions, a 4-3 vote with Carley, Melton, and Nahmias dissenting.

The Court also issued a substitute opinion, which made no changes to the majority decision. The revisions are to Justice Nahmias’ dissent, adding discussion of some issues raised in the motions for reconsideration. We have prepared a comparison version showing the revisions.

UPDATE: This afternoon, the Supreme Court closed the January 2011 Term of Court effective today. The Court had earlier extended the two-term rule to allow its consideration of this case and the motions for reconsideration.
